James Sewell filed a sworn Wisconsin Statute § 5.06 complaint related to alleged failures by numerous poll workers in different Racine wards to properly mark remade ballots in accordance with the procedures outlined in Wis. Stat. § 5.85. The complaint has not been resolved.

The WEC was not involved in municipalities applying for or receiving private grant funds. WEC did not inform clerks about the private grants and did not promote them. Acceptance of grant funds by a municipality is a municipal decision that is subject to a municipality’s approval structure, be it by the clerk’s supervisor, mayor, City Council, or Town or Village Board. Whether statutes should regulate private election grants in the future is up to the Legislature to decide.

The issue of restricted access to facilities served by SVDs was not new in 2020, as other public health concerns, such as influenza and MRSA, have previously caused access issues. Clerks have always been advised to follow the statutory prescribed process of mailing ballots to voters normally served by SVDs if the voter, or facility, was not available for SVD visits. The COVID-19 pandemic exacerbated these situations, which had been sporadic in the past, but the process of mailing ballots to nursing home and care facility residents was not new for many clerks.
