Advisory Opinions

Wisconsin Statutes § 5.05(6a) provides the authority under which “Any individual, either personally or on behalf of an organization or governmental body, may make a request of the commission in writing, electronically, or by telephone for a formal or informal advisory opinion regarding the propriety under chs. 5 to 10 or 12 of any matter to which the person is or may become a party.” Advisory opinions provide individuals and entities with an opportunity to seek valuable clarity relating to election statutes under the purview of the Wisconsin Elections Commission. Utilizing the advisory opinion request process may be appropriate for people who:

•    have questions about a provision of Chapters 5-10, 12 of the Wisconsin Statutes.

•    have other election-related questions that may impact the requester or their organization.

•    wish to have the Wisconsin Elections Commission provide formal or informal opinions on ambiguous areas of election law or procedure.

Advisory opinions published below by the Wisconsin Elections Commission were originally requested by an individual or entity seeking clarification relating to Chapters 5-10, 12 of the Wisconsin Statutes or other election-related procedures.
