This afternoon the Wisconsin Supreme Court issued a decision in the Hawkins (Green Party) matter. The Court denied the petition for ballot access to candidates Howie Hawkins and Angela Walker representing the Green Party for the November 3, 2020 Presidential Election. The Court further vacated the order to suspend the sending of ballots. The Wisconsin Supreme Court’s order is attached.
What does this mean for clerks?
Today’s decision means that municipal and county clerks should proceed with preparing, printing, and sending absentee ballots in accordance with both federal law and Wisconsin state law. In a related reminder, the Brown County Circuit Court also denied ballot access to candidate Kanye West last week.
The ballot has not changed, the candidates and ballot order certified by the Commission on September 1 stands.
County Clerks: Proceed with printing and distributing ballots to municipalities by the statutory deadline of September 16, 2020.
Municipal Clerks: Proceed with mailing absentee ballots to all voters with requests on file by the statutory deadline of September 17, 2020 and the federal UOCAVA deadline of September 19.
